Court Restrains Demolition Drives Until Further Directions

The Telangana High Court has directed HYDRA to stop all demolition activities until further orders are issued. The directive comes while hearing a case filed by residents of Ailapur village in Aminpur mandal.

The court made it clear that no further demolitions should be carried out by HYDRA until a proper framework is established and placed before the court.

Court Flags Lack of Procedure and Due Process

During the hearing, the High Court observed that HYDRA currently operates without defined procedures or standard operating guidelines. It noted that demolitions were being conducted without issuing prior notices.

The court remarked that such actions appear arbitrary and lack procedural backing, raising concerns over due process and administrative accountability.

Demolition Drives Compared to War-Like Situation

The bench took note of the scale and manner in which demolitions were being carried out. It was observed that the presence of hundreds of personnel during such drives creates a situation resembling a war-like scenario.

The court highlighted that enforcement actions must follow a structured and lawful approach rather than large-scale operations without clear guidelines.

Limited Scope for Removal of Encroachments

The High Court permitted HYDRA to act only in specific cases involving encroachments on lakes, drainage canals, and parks. However, it directed that even such actions must be taken only after submitting standard operating procedures (SOPs) before the court.

The court emphasised that removals should be restricted to these categories and must follow a transparent and approved process.

Directions on Roads and Other Constructions

Apart from restricting demolitions, the court instructed HYDRA to focus on road restoration works. It also clearly stated that no demolition of unauthorised constructions in other areas should be undertaken.

These directions aim to bring administrative clarity and prevent further disputes arising from ongoing demolition activities.

The matter arose from petitions filed by residents of Ailapur village in Aminpur mandal, who challenged the ongoing demolition drives. The High Court is expected to review the matter further after examining the SOPs to be submitted.

The interim order remains in force until the court issues fresh directions on the functioning and powers of HYDRA.
